PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING CONTRACT THAT AFFECTS YOUR LEGAL RIGHTS. This Agreement is between Bearmouth Precision, LLC (“Bearmouth,” “Provider”) and the person signing below (and, where a parent/guardian signs, the minor identified). It applies to every person who participates in, observes, spectates at, assists with, or is otherwise present at any Bearmouth activity or event, on Bearmouth property or at any off-site location, regardless of role.

1. Term

This Agreement is effective on the date signed and applies to the single event identified above, including all related activities, travel, transport, staging, observation, and instruction. A new Agreement must be signed before each subsequent event.

2. Activities Covered

Firearms instruction and live-fire / target / long-range shooting with handguns, rifles, shotguns, and other weapons systems; archery and crossbow; hunting and field activities; horseback riding and equine activities; off-roading and OHV/ATV/UTV operation; hiking, backcountry travel, and camping; related travel and transport; and any other recreational activity, clinic, competition, demonstration, or guided outing offered, sponsored, hosted, or made available by Bearmouth, whether or not specifically listed. Omission of an activity does not remove it from this Agreement.

3. Assumption of Inherent and Other Risks

Under Mont. Code Ann. §§ 27-1-751 to 754, a person who participates in any sport or recreational opportunity assumes the inherent risks of that activity, known or unknown, and is legally responsible for resulting injury, death, or property damage. Known inherent risks include, without limitation:

General: rough or unstable terrain; remote locations with limited communication and delayed emergency response and evacuation; sudden or extreme weather, lightning, heat, cold; wildlife, livestock, insects, snakes, and allergic reactions; slips, falls, collisions, cuts, fractures, burns; equipment failure; my own physical condition; and the negligent, careless, reckless, or intentional acts of other participants or third parties.

Firearms & shooting: discharge of firearms and gunshot wounds, including serious injury, paralysis, or death; ricochets, splatter, fragmentation, and debris; ejected hot brass and burns; muzzle blast; permanent hearing loss, tinnitus, and eye injury; recoil injury; malfunctions, squib loads, and explosions; lead and combustion-byproduct exposure; and unsafe handling by others.

Archery/crossbow: penetrating injury from arrows or bolts; bowstring/limb injury; dry-fire and equipment failure. Hunting: all firearms/archery risks in uncontrolled field conditions; tree stands and falls from height; game and non-game animals; becoming lost; hypothermia and exhaustion. Equine: horses are large, powerful, unpredictable animals that may bolt, buck, rear, kick, bite, stumble, or fall; falling from, being thrown, stepped on, or crushed. OHV/off-road: rollover, collision, ejection, loss of control, terrain hazards, mechanical failure, operator error. Hiking/backcountry: falls, altitude, exposure, water crossings, becoming lost, limited emergency access.

4. Statutory Notice

By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider’s ordinary negligence that are the result of the provider’s failure to exercise reasonable care.

5. Release and Waiver

To the fullest extent permitted by Montana law, I release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, liabilities, damages, costs, and expenses (including attorney fees) arising out of any loss, injury, illness, death, or property damage sustained by me in connection with the Activities or my presence at any Premises or Event, including claims arising from the inherent risks above and from the ordinary negligence of the Released Parties.

Released Parties means: Bearmouth and its members, managers, officers, directors, employees, instructors, range safety officers, guides, wranglers, assistants, helpers, associates, volunteers, independent contractors, agents, and sponsors; Tomahawk Lodge, LLC (Hall, Montana) and its owners, operators, members, managers, employees, agents, contractors, volunteers, and guests; each owner, lessor, lessee, manager, or occupant of any property used for an Event (Host Landowners) and their family, employees, agents, and insurers; and the heirs, successors, assigns, and insurers of each.

Limitation: this release does not apply to gross negligence, willful or wanton misconduct, recklessness, intentional acts, or violations of law that may not be released under Montana law. Unenforceability as to any such claim does not affect the rest of this Agreement.

6. Indemnification

To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless the Released Parties from any claim brought by me, on my behalf, or by any third party arising out of my participation, my presence, my use or handling of any firearm, equipment, animal, or vehicle, or my violation of any rule or instruction, including derivative claims by my spouse, family, heirs, or estate.

7. Safety, Sobriety & Physical Condition

I will obey all instructions and commands of instructors, range safety officers, guides, and staff immediately; follow the universal firearm safety rules; wear required eye and ear protection; and not handle any firearm, animal, or vehicle without authorization. I am not and will not become impaired by alcohol, cannabis, drugs, or impairing medication during any activity. I am physically able to participate or assume all risk of any condition. I authorize the Released Parties to obtain or administer emergency medical care and transport, at my sole expense, and I am responsible for my own health/accident insurance.

8. Firearms, Equipment, Animals & Vehicles

If I bring my own firearm, ammunition, archery equipment, vehicle, or other equipment, I represent it is lawful for me to possess, in safe and functioning condition, and appropriate for the Activity, and I am responsible for its safe use. If Bearmouth furnishes any firearm, ammunition, equipment, animal, or vehicle, I will inspect it, follow all instructions, immediately report any defect, and I use it voluntarily and at my own risk.

9. Participants Under 18

If the participant is under 18, a parent or legal guardian signs below and, on behalf of themselves and the minor: represents full authority to sign; assumes all risks for the minor; agrees to the release and waiver in Section 5; and agrees to indemnify the Released Parties under Section 6 for any claim by, on behalf of, or related to the minor, including claims the minor may bring upon reaching the age of majority.

10. General

Governed by Montana law; exclusive venue in Granite County, Montana. Binds my spouse, family, heirs, next of kin, estate, and assigns. Severable. Entire agreement; amendable only in a writing signed by Bearmouth; I have not relied on any oral representation. Each non-signing Released Party is an intended third-party beneficiary who may enforce this Agreement in its own name.

A range safety officer (RSO) or staff member may stop any activity at any time, and may remove me from the Event without refund for any violation.
